Terms and conditions of your use of this site and submitting images.

Welcome to the Hidden Journeys: exploration from the air website ('this site'). This site is operated by the Royal Geographical Society (with the Institute of British Geographers) of 1 Kensington Gore, London, SW7 2AR, United Kingdom ('we', 'us', 'our', 'RGS-IBG'). Thank you for reviewing our terms and conditions of use of this site and submitting images (terms). Please note these terms contain terms (highlighted in blue) which exclude or limit our legal liability to you. If you do not agree to these terms, you should not use this site.

SUBMITTING YOUR IMAGE

1.By submitting your photo to this site, you agree to the following terms. Before submitting your photo, please read these terms carefully, as they contain standards which you must comply with, and important information about what rights the RGS-IBG will have to use your photo. By submitting your photo, you are deemed to have accepted these terms.

2.By submitting your photo with to this site, you confirm that it:

• is your original work and that you have the right to give us the permission to use it for the purposes specified in these terms.

• does not infringe the copyright or any other rights of any third party, including those of any people in the photo and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16.

• does not contain any obscene or defamatory content or material.

3.By submitting your photo to the website, you grant us a non-exclusive, worldwide, royalty-free, licence to display your photo (including modifying and adapting it for operational and editorial reasons) on the website and/or from the RGS-IBG’s server (including in a live gallery) where such display is connected with the ‘Hidden Journeys’ project.

4.This licence shall apply for the period during which the photo is submitted to this website. If you wish to withdraw your image, please contact the web editor requesting a termination of this license, and your photo will no longer be displayed on the website.

5. Copyright for your submitted photo will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it. Your image will be displayed with a credit to the original author.

6.Unless the we have contacted you and obtained your express approval, we will only use your photo by displaying it on the website and/or from RGS-IBG server (including in a live gallery) and where such display is connected with RGS-IBG’s ‘Hidden Journeys’ project.

7.The RGS-IBG shall not be obliged to display your photo once it has been submitted and shall not have any liability to you for any loss of publicity or enhancement of reputation.

9. If you do not want to grant the RGS-IBG the permission set out in these terms, please do not submit your contribution to the website. 

YOUR USE OF THIS SITE

Flight paths. Flight paths change from day to day for a number of financial, political and meteoroligical reasons. In this site we have accommodated the variations which occur in each flight path. However the flight distance and times should not be taken as fact due to the daily changes in the distances and routes taken by international airliners.

Copyright. The copyright and other intellectual property rights in all content included on this site is either owned by us or licensed to us. You may use the material on this web site for your own private study, non-commercial research, and non-commercial instructional or educational purposes (including use on an educational intranet restricted to authenticated users). All copies of any part of the content material must bear an acknowledgement of the copyright of the owner of the material. Copyright, trademark and other proprietary notices must not be removed.

For use of all images and content on this site not copyrighted by the Royal Geographical Society with IBG, you should read the original copyright license of that image by following the link provided below the image.

You may not use any Royal Geographical Society with IBG content on this site for any other purpose without our prior written consent. Examples of prohibited use include (without limitation):

• reproducing any content for commercial purposes; or

• inclusion of any content on any other website (whether commercial or not).

Other People's Rights. You must not use this site to transmit or upload or otherwise publish:

Misuse of site. You agree not to use any mechanism, device, software, script or routine to affect the proper functioning of the site. You agree not take any action that places an unreasonable burden or excessive load on our system(s). You agree not to infect the site with any computer programming routine (e.g., any virus, worm, time bomb, cancelbot or trojan horse) that may damage, interfere with, delay, intercept or expropriate any system, data or personal information.

Linking to our site. You do not need our permission to link directly to pages on this site. However:

• pages from this site must load into the user's entire window without being "framed" in any way by other content;

• you may not incorporate content (for example, an individual image) into any page on your website without our prior written consent; and

Copyright. Every effort has been made to locate copyright holders of material included on this website in order to obtain their permission to publish it, as well as displaying the correct copyright notice for images that we have used on this site. Accuracy of content. We take reasonable care to ensure that the information appearing on this site is accurate and up-to-date. However, errors and omissions do occur, and you should not take the accuracy of the information for granted, but should check directly with us using the contact details provided on this site. None of the material contained in this site is to be relied upon as a statement or representation of fact.

Information collected. We collect personal information from you in order that our services can be offered as effectively as is possible.  The only personal information we routinely collect is the information requested on forms contained on our website.

Like most websites, we routinely monitor IP addresses of the computer from which users access the site.  We use such data only to monitor levels of traffic to the site, and we do not match this data with individual user records.

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”).  Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States.

Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.

__utma

This cookie is typically written to the browser upon the first visit to your site from that web browser. If the cookie has been deleted by the browser operator, and the browser subsequently visits your site, a new __utma cookie is written with a different unique ID. This cookie is used to determine unique visitors to your site and it is updated with each page view. Additionally, this cookie is provided with a unique ID that Google Analytics uses to ensure both the validity and accessibility of the cookie as an extra security measure.

This cookie is used to establish and continue a user session with your site. When a user views a page on your site, the Google Analytics code attempts to update this cookie. If it does not find the cookie, a new one is written and a new session is established. Each time a user visits a different page on your site, this cookie is updated to expire in 30 minutes, thus continuing a single session for as long as user activity continues within 30-minute intervals. This cookie expires when a user pauses on a page on your site for longer than 30 minutes. You can modify the default length of a user session with the _setSessionCookieTimeout() method.

__utmz

This cookie stores the type of referral used by the visitor to reach your site, whether via a direct method, a referring link, a website search, or a campaign such as an ad or an email link. It is used to calculate search engine traffic, ad campaigns and page navigation within your own site. The cookie is updated with each page view to your site.

__utmv

This cookie is not normally present in a default configuration of the tracking code. The __utmv cookie passes the information provided via the _setVar() method, which you use to create a custom user segment. This string is then passed to the Analytics servers in the GIF request URL via the utmcc parameter. This cookie is only written if you have added the _setVar() method for the tracking code on your website page.

This cookie is used by Website Optiizer and only set when the Website Optimizer tracking code is installed and correctly configured for your pages. Changes to these terms. We reserve the right to change these terms at any time. The terms displayed on the site when you visit will be the terms that apply to you for that visit.
Governing Law. Any dispute or claim concerning or arising from this website is to be determined in accordance with the law of England and Wales, and the courts of England and Wales are to have exclusive jurisdiction in determining such disputes or claims.

TERMS AND CONDITIONS OF USE

1 Provision of Service

1.1 The Hidden Journeys website ("the Site") is operated by the Royal Geographical Society (with the Institute of British Geographers) of 1 Kensington Gore, London, SW7 2AR, United Kingdom ('we', 'us', 'our'). For our other contact details, please see our contacts page at www.rgs.org. We agree to provide you with reasonable support by telephone or email during normal working hours for the purpose of assisting you to maintain your access to the Site.

2 Limited Rights to Use Content

2.1 All material displayed on the Site ("Content") belongs to us or our licensors. Subject to clause 2.2, your Users may retrieve and display the Content on a computer screen, print individual pages on paper and store such pages in electronic form on disk and on your internal server (but not on any other server or other storage device connected to an external network unless we have agreed to do this) for your internal educational non-commercial purposes.

2.2 Some of the Content on the Site is owned by us but most content is used under license from third parties ("Third Party Content") and will be marked with the copyright notice of those third parties and a link to the original source of the image. Some of the Third Party Content will be subject to additional restrictions - the relevant copyright notice will make it clear where that is the case. You are responsible for ensuring that your Users comply with such restrictions.

2.3 You may not (without prior written permission from us):

2.3.1 redistribute any of the Content (including by using it as part of any library, archive or similar service);

2.3.2 remove the copyright or trade mark notice from any copies of Content made under this Agreement;

2.3.3 create a database in electronic or structured manual form by systematically downloading and storing all or any of the Content;

2.3.4 except as expressly set out above, modify, reproduce or in any way commercially exploit any of the Content.

2.4 You acknowledge that "Royal Geographical Society (with IBG)", "Hidden Journeys: exploration from the air" are trade marks and that you may not use them without written permission.

3 Participation

3.1 The opinions, advice and statements contained in messages posted on the Site ("Messages") are those of the Users and not us. Copyright in any software that is made available for download for the participation in the Service ("Software") belongs to us or its suppliers. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Certain promotions on the Site may also be subject to particular terms which will be made available by hyperlink. You will be responsible for ensuring that Users comply with all such terms referred to in this clause 3.1.

4 Warranties

4.1 We will use our reasonable skill in making the website and its content available to you and in ensuring its continuing availability. However, because of the number of sources from which we obtain the Content and because of the nature of the Internet and computer software and hardware, errors and omissions do occur and we do not give any other warranties in respect of this. In particular, you should not take the accuracy of the information for granted and we make no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. All implied warranties are excluded from this Agreement to the extent that they may be excluded as a matter of law.

5 Changes

5.1 We will continually seek to improve this site. We reserve the right, at our discretion, to make changes to any part of this site provided that it does not materially reduce the content or functionality of the relevant service.

6 Links

6.1 This site contains links to other websites and resources, either directly or through frames and, where possible, we will make clear where such links are being made. Independent third parties provide these sites and we are not responsible and shall not be liable for the availability or content of these outside resources.

7 General

7.1 If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

7.2 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

7.3 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

7.4 This Agreement shall be governed by, and construed in accordance with, English law. The parties irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with this Agreement or the legal relationship established by it, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.

7.5 Headings in this Agreement are for convenience only and will have no legal meaning or effect.
